This user agreement confirms our terms and conditions of business for use of our web site. Use of our web site by you is your express acceptance of them.

2. Your information

We need to obtain some personal information to provide you with an efficient and personalised experience. We only collect personal information about you that we consider necessary for this purpose.

2.7 Amendment, review and removal of information
You can change your username and password, contact information, financial information, postal address and user preferences via the ‘Login' button on our web site. You must immediately update your personal information if it changes or is inaccurate.
We can close your account and deactivate your information and financial information from our active databases. To enable this please email your request to our customer support team at mailbox@moveonethenet.com . We will endeavour to deal with your request as soon as is reasonably practicable.
We will retain information you have requested to remove in some circumstances, such as if it may help us to resolve disputes or enforce our contractual rights. Some information is never completely removed from our databases due to technical and legal constraints, including stored "back up" systems. If you are a selling or renting a property, you must ensure that you are legally able to sell or rent (or are legally able to act as agent for the party who is legally able to sell or rent) each property you advertise on our web site.
You must describe your property fairly, truthfully and in such details so as to avoid any confusion. Your listings may only include text descriptions, pictures, video footage and other content relevant to the property. We refer you to the section ‘Your Information' above.
You are responsible for ensuring that you have the right to use all the content in your advertisings. You are responsible for ensuring that we have the right to post your advertising on our web site.
3.2 Licence
By advertising your property on www.moveonthenet.com you grant move although the net Limited a non-exclusive, world-wide, perpetual, irrevocable, royalty-free, sub licensable (through multiple tiers) licence to exercise the copyright, trade mark, publicity, and database rights you have in Your information and advertising, in any media now known or unknown. You also waive all moral rights you have in your advertising and your information, to the fullest extent permitted by law.

4. Fees and refunds
4.1 Fees
You may browse our web site free of charge.
The costs of accessing our web site and communicating with others through our web site remain your responsibility.
We charge fees for advertising properties for sale or to let and other related services through our web site. We charge, in addition to network providers' charges (which remain the responsibility of the network account holder), for sms text alerts.
Our fees are:
The move on the net advertising package 1 - £99.00 including VAT.
The move on the net advertising package 2 - £134.00 including VAT.
The move on the net advertising package 3 - £154.00 including VAT.
Additional for sale sign information vinyl slips - £15 per slip including VAT and post and packaging.
Additional for sale sign information small boards - £15 per slip including VAT and post and packaging.
For sale sign posts and fixings- £25.00 each including VAT and post and packaging.
For sale sign boards - £40.00 each including VAT and post and packaging.
SMS text alerts – £0.50 per text including VAT, excluding network charges. Bought in bundles of 20.
We may choose to temporarily change our fees and the fees for our services for promotional events (for example, free listing weeks) - these changes are effective when we announce the temporary promotional event on our web site or in other media. Promotional events shall not apply to any advertising existing on our web site at the time of the announcement.
We may change some or all of our services at any time. If we choose to introduce a new service, the fees for that service are effective at the launch of the service and will not apply to any pre existing advertisings.
Any permanent change to our fees will apply to new advertisings entered after the new fees are announced on our web site.
Unless otherwise stated, all fees are payable in GB Pounds sterling. Whether you are a business or not, value added tax and other taxes may apply to your transaction. Sellers will be responsible for paying all fees and taxes associated with using our service.
You agree that we may issue you with invoices in electronic format and may deliver them by email.
4.2 Refunds
The only circumstance that will warrant a refund is on the catastrophic failure of www.moveonthenet.com to be live on the World Wide Web for a period exceeding 31 continuous days. In those circumstances you may refund request by email to our customer support team at mailbox@moveonthenet.com . Alternatively, at our sole discretion we may offer to extend the free of charge advertising period by the number of days that www.moveonthenet.com was not live on the World Wide Web.
Any refund will be paid by means of a banker's cheque payable a minimum 49 days after you authorised payment, submitted to the cardholders address as provided at the time of payment.
5. Limitation of Liability
OUR LIABILITY TO YOU
Although for practical purposes we provide an open-ended service (see no time-limit above), for various legal reasons we are obliged to restrict our financial liability.
The price we charge relates essentially to the set up cost of each paid property advertisement and the initial administration involved. In consequence once a customer's property details have been published on this site for a period EXCEEDING 1 calendar month, our service is deemed to have been fully delivered.
After the 1month 'paid-up' period, advertising and support is continued for a further 5 months (or until the property advertised is subject to an agreed sale, whichever is the sooner) FREE OF CHARGE.
Arrangements to publish properties on our partner sites may be subject to alteration or cancellation without notice according to changes in service or costs imposed on us by partner web sites. As such, we do not guarantee unlimited publication on partner web sites (paid or not), although where available our practice will be to offer an unrestricted access period.
The maximum liability for any loss arising due to our negligence will be limited to a sum equal to the value of the advertising fee received.
Move on the net limited (including our parent, subsidiaries, affiliates, officers, directors, agents and employees) will not be liable for any economic losses (including, without limitation, loss of revenues, profits, contracts, sales, business or anticipated savings), any loss of goodwill or reputation, or any special, indirect or consequential damages (however arising, including negligence) arising out of or in connection with this User Agreement.
Move on the net limited (including our parent, subsidiaries, affiliates, officers, directors, agents and employees) also have no liability of any sort (including liability for negligence) for the acts or omissions of any providers of telecommunications services or for faults in or failures of their networks and equipment.
The erection, display and maintenance of any Move on the net for sale or for let sign or any other signage or board is solely your responsibility. Responsibility for any signage passes to the purchaser of the signage immediately when payment is made to us.You must ensure that you have permission to display any signage and that your display meets all legislative and regulatory requirements. You are referred to, amongst others, the local authority where any display may take place and to the Office for the Deputy Prime Minister: (External) http://www.odpm.gov.uk/ for the latest guidance. You should display any signage securely, safely and sensibly. You are responsible if any signage causes injury, loss, damage or death.
6. Publishing elsewhere
As part of some of our packages we may agree to publish your advertisement on partner web sites. Whilst we have no control over the availability of partner web sites we shall only contract with web sites that can enhance your advertising potential and who have a proven track record of delivery. The selection of partner web sites will be at the sole discretion of Move on the net limited.
We cannot accept any responsibility for interruptions or delay in publication of your advertisement at partner web sites due (but not limited to) to necessary maintenance; web site upgrades; technical reasons; and matters beyond the control of Move on the net limited.
Publication issues such as (but not limited to) formatting, timing, placement, search criteria, presentation etc on our partner web sites is controlled by the individual web?sites. We have no control over the individual web sites and we accept no liability for any publication issues that arise partner web sites.
7. Interruption in service
In circumstances that are (but not limited to) due to necessary maintenance; web site upgrades; technical reasons; and matters beyond the control of Move on the net limited, interruptions in service may arise. We will use our best endeavours to keep interruptions to an absolute minimum.
We aim to deliver uninterrupted service but offer no guarantees on the length of any interruptions in service.
8. No Cancellation
You acknowledge that we will commence supplying our services to you as soon as you click the ‘Authorise' button on the “ENTER YOUR CREDIT/DEBIT CARD DETAILS�. Clause 8(3) of The Consumer Protection (Distance Selling) Regulations 2000 states that the statutory cancellation (cooling-off) period of 7 days for services purchased over the internet, does not apply where performance of that service has already commenced with the customer's agreement.
Our online payment facilities are designed to activate your public advertising automatically and immediately. By authorising a payment for advertising on this site you confirm your agreement to the advertising service commencing IMMEDIATELY and that the statutory cooling-off period does not apply.
9. Password
For your own security you must not disclose your www.moveonthenet.com password to any third party. You are responsible for all actions taken with your username and password. If you forget your username then please e-mail our customer support team at mailbox@moveonthenet.com and they will assist you with a reminder. If you feel that your account has been compromised for any reason, you must immediately change your password by editing your account details in the your account page.
10. Security
Move on the net treats data as an asset that must be protected against loss and unauthorised access. We will use our best endeavours to make our web site as secure as is reasonably possible by engaging security techniques to protect data from unauthorised access by users inside and outside the web site.
Move on the net uses industry standard practices to safeguard the confidentiality of your personal identifiable information, including encryption, "firewalls" and Secure Socket Layers.
Move on the net does not claim impliedly or expressly that www.moveonthenet.com is secure.
11. Fraud
Without limiting any other remedies, we may suspend or terminate your account if we suspect that you have engaged or are about to engage in, or have been in any way involved in or linked to, fraudulent activity in connection with the web site. From time to time we may audit payments and activity on our web site to comply with any money laundering legislation.
12. Amendments
From time to time our terms and conditions, user agreement and policies will, by necessity, change. These may affect your continued use of our web site. Move on the net limited will publish the date of the last amendment on www.moveonthenet.com .
We will give you notice of any amendments by either e-mail or by posting the amended terms and conditions of business and User Agreement on our web site. Any amended terms of business and User Agreement will govern new user registrations from the date they are posted on the web site. You agree to indemnify Move on the net limited and (as applicable) our parent, subsidiaries, affiliates, officers, directors, agents and employees, from any claim or demand, including reasonable legal fees, known and unknown made by any third party due to or arising out of your breach of this User Agreement (including the documents incorporated by reference), or your violation of any law or the rights of a third party. .
In the event that you have any right, claim or action against any other user arising from that user's use of our web site, you agree to pursue such right, claim or action independently of and without recourse to us, and you release Move on the net limited, our parent, subsidiaries, affiliates, officers, directors, agents and employees from all claims, liability, damages, losses, costs and expenses, including legal fees, known and unknown, arising from or in any way connected with such right, claim or action.

We aim to help all our customers sell their property swiftly and cost effectively. If you have a complaint about our web site or our service then please do let us know. We will attempt to deal constructively with any complaints raised by you, in an effort to make you satisfied with the service you receive. 17. Notices
Any notices to Move on the net limited must be sent by recorded delivery to the registered office as published on www.moveonthenet.com . Notices to you will be sent to either the email address or postal address that you provide to www.moveonthenet.com during the registration process. Receipt of notices to you is deemed at 24 hours after an email is sent, unless notice is received that the email address is invalid.

If any provision of this User Agreement is held to be invalid or unenforceable, such provision shall be deemed struck out and the remaining provisions shall be enforceable.
You agree that this User Agreement and all incorporated agreements may be automatically assigned by Move on the net limited at their sole discretion, to a third party in the event of a merger or acquisition or any other event. You and Move on the net limited are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this User Agreement.
Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section.
Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.
This User Agreement is the entire understanding and agreement between us with respect to its subject matter.
No oral explanation or oral information given by any party shall in any way alter the interpretation of this User Agreement.
19. Disclaimer
Move on the net limited endeavours to provide accurate information but disclaims all warranties with regard to the information contained on all pages at www.moveonthenet.com .
In no event or circumstance shall Move on the net limited be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use of data or profits, whether in an action of contract, negligence or other tortious action, arising out of or in connection with the use or performance of this information.
All property listings, and the content described with the each advert are based upon information supplied and edited directly by the advertiser. Property advertisements are displayed in good faith and do not constitute or form part of any contract.
Move on the net limited recommends that professional and legal advice is taken before entering into any form of transaction or contract and that all particulars are verified independently prior to entering into any form of transaction or contract. Move on the net does not encourage you to break any pre-existing contractual obligations you may have regarding your property sale.
20. Legal
Our contract, terms and conditions and user agreements are to be governed by English law under the sole jurisdiction of English courts. Our VAT registration number is: 876 3113 17.
